 UPON hearing the counsel the Court made the following

 O R D E R

1. The petitioner has filed the present petition under Article

32 of the Constitution seeking following reliefs :

“a. Issue a Writ in the nature of mandamus, or

any other appropriate writ, order or

direction, directing the Respondents to

immediately revise the existing wage

ceiling of Rs.15,000, which has remained

unchanged since 2014, in accordance with

the recommendations made by the SubCommittee on Enhancing Coverage and

Managing Related Litigation, as approved by

the Central Board of Trustees of EPFO in

July 2022;

b. Issue a Writ of Mandamus, or any other

appropriate writ, order or direction,

directing the Respondents to consider and

implement a dynamic formula or objective

criteria for future revisions of the wage

ceiling under the Employees Provident Fund

Scheme;

c. Issue a Writ in the nature of Mandamus or

any other Writ/Orders/Directions directing

the Respondents to notify a mandatory

mechanism for annual periodic revision of

the wage ceiling under Paragraph 2(f) of

the employees Provident Scheme, 1952, in

line with relevant economic indicators such

as minimum wages, inflation, Consumer Price

Index, Income Tax exemption thresholds, and

per capita Net National Income;

2. After hearing learned counsel for the petitioner, we find

that issue requires active consideration by the Union of India to

address the grievance as posed in the grounds mentioned in this

petition. However, at this stage, we are not entertaining the

petition and relegate the petitioner to file a representation

before the appropriate authority within a period of two weeks and

place the order of this Court passed today before the said

authority. On receiving such representation, the authority shall

place the matter at appropriate level and take a decision in

accordance with law within a period of four months.

3. In view of the above, the Writ Petition is disposed of.

Pending applications, if any, shall stand disposed of.
