INDUSTRIAL DISPUTES ACT, 1947 – Section 2(j) –  Industry – Co-operative Housing Society is not an ‘industry’ – Workman challenged his termination from service after receiving ex-gratia/ retirement benefits – Later on the workman challenged his termination on the ground that he was neither paid retrenchment compensation nor any enquiry was conducted – Management’s took stand that society not being an industry and employee not being ‘workman’ under the Act, reference of dispute is not maintainable – Labour Court held the reference maintainable holding that society is having profit motive by way of additional income from its members –Management challenged the finding of the Labour Court in writ petition – Held, a few members of society running coaching clas
